    Introduction

    Thank you for using the advertising services provided by the Bybit P2P Platform.

     

    This Agreement is between Bybit P2P (hereinafter referred to as "Platform" or "we") and the "Advertisers'' on the Platform (hereinafter referred to as "you"). Making any requests through our website, API (if any), mobile application and any other web pages, or publishing any advertisements using our service indicates that you have fully read, understood, and agreed to be bound by this Agreement and the various rules and information described on the Services pages, including any amendment, modification, or alteration thereof, and any new rules that may be issued at any time in the future (collectively, the "Agreement"). Please immediately stop using our advertising services and request that the Platform disqualify the Advertiser if you do not agree with this Policy and any amended terms.

     

     

    Important Points to Note:

    1. You will be bound by this Agreement and the various rules and information of this Platform once you have successfully obtained permission to publish advertisements.

    2. These terms shall take effect on the date they are published and may be amended at any time. Amendments shall take effect from the date they are published. As the Advertiser, you are an independent and autonomous party to The newly amended terms shall apply if any part of this Agreement is inconsistent with new amended terms announced publicly.

    3. transactions on the Platform. You can only publish advertisements after being approved and verified by the Platform. However, this does not imply that any advertisements made through the Platform are fully credible, nor does it imply that the Platform guarantees the claims made by any Advertisers. If the Platform or the system's rules have been violated, we do not guarantee any brand or credit promises made by the Advertiser, nor are we jointly liable for any negative consequences arising from the Advertiser's actions.

    4. The Advertiser shall ensure that they use the services provided under this Agreement solely for legal purposes. You are strictly prohibited from using the Platform and your advertising permissions to engage in any illegal transactions or illegal activities such as money laundering, smuggling, bribery, malicious market manipulation, or interfering with transaction systems. If you are discovered by the Platform to have violated the above rules, we are entitled to take punitive measures against you, including but not limited to freezing or restricting your account, disqualifying you from publishing advertisements, or reporting your actions to the judicial authorities. We are not liable for any losses suffered by you or any third parties resulting from your actions.

     

     

    Applicable Scope

    The services under this Agreement are applicable to all Advertisers who pass the request approval.

     

     

    Service Items

    You will be eligible to publish advertisements and formally become an Advertiser on the Platform after applying for and passing a review by the Platform and becoming qualified. You will also have access to the following extra services not available to ordinary users:

     

    Advertisement Publishing Services: After qualifying as an Advertiser, you will have permission to publish advertisements, allowing you to carry out transactions more conveniently and with greater flexibility.

     

    One-to-one Customer Services: We provide one-to-one customer service to Advertisers, improving the transaction process and allowing you to resolve potential order complaints more effectively.

     

    Other Services: The Platform may launch other new products and services for Advertisers, or adjust and upgrade the existing products and services provided at any time following changes in Platform policy. Please refer to our website's service and product page for information on specific service updates.

     

     

    Basic Criteria

    A good Advertiser should make payments promptly, release funds quickly, and respond quickly to customers. Advertisers should follow the basic principles for carrying out fair transactions in good faith, and have a good service attitude, a strong sense of service, and respect for the Platform's users and employees. They should not arbitrarily cancel orders, maliciously file disputes, cheat buyers, or take advantage of low-price orders.

     

     

    Transaction Guidelines

    Guidelines for Making and Receiving Payments

    1. The Advertiser is required to use an account that has been verified by the Platform to transfer money to the user.

    1. The Advertiser is required to use an account verified by the Platform to receive payments from users.

    1. Advertisers may cancel orders to users if the user requests that the Advertiser make payments to a non-verified account.

    1. Advertisers can request that users cancel orders made to them if the user uses a non-verified account to pay for the order. If payment funds have already entered the Advertiser's accounts, the Advertiser can refund this payment and request that the user cancels their order.

     

    Guidelines for Fund Security

    1. Advertisers shall not take part in any transactions involving illegal funds.

    1. Advertisers shall actively cooperate with the Platform's employees and provide the evidence required if users file complaints alleging that their bank cards or other accounts have been frozen due to payments received from the Advertiser.

    1. If an Advertiser's account has been frozen, the Advertiser should contact customer service, provide details for the frozen account, and provide reasonable evidence that the account has been frozen due to reasons related to the Platform's users as quickly as possible.

    1. The Platform has the right to disqualify the Advertiser from accessing advertising services if the Advertiser introduces illegal digital assets or funds onto the Platform which results in losses to the assets of the Platform or its users, or legal risks. The Platform will cooperate with the judicial authorities in particularly serious cases and freeze Advertiser accounts and assets.

     

    Operating Guidelines

    1. We discourage Advertisers from leaving contact information in remarks which would allow Platform users to communicate with them through other channels, such as the Telegram app. We are not responsible for any losses or damages resulting from direct transactions carried out outside the Platform.

    1. If payment is not released within 10 minutes of assets being transferred, the Advertiser may click on "Complaint" and immediately contact customer service.

    1. Without the user's consent, the Advertiser may not make a small amount of money transfer to the user's bank account or other financial accounts for testing purposes. Two such transfers will result in the Advertiser's disqualification.

     

    If one of the following circumstances occur, the Advertiser will be disqualified:

    1. Within a 30-day period, the Advertiser receives more than seven (7) warnings.

    1. The Advertiser does not cooperate with the settlement process for the second time when users' or other Advertisers' bank cards are frozen as a result of the Advertiser's payment.

    1. Where an Advertiser fails to cooperate with customer service to process orders or purposefully delays the trading process, the Advertiser will be disqualified if the circumstances are serious. If the Platform suffers a loss of user assets, it reserves the right to disqualify the Advertiser, freeze the account, and refund the money to users.

    1. The Advertiser will be disqualified if the user incurs losses as a result of the Advertiser's failure to cooperate on order disputes. The account may also be blocked based on the severity of the circumstances.

    1. The Advertiser charges users additional fees, or takes kickbacks or commissions privately under any pretext.

    1. The Advertiser divulges the user's name, contact information, and address, as well as other pertinent information, resulting in adverse impacts.

    1. The Advertiser distributes advertisements and disseminates negative information about the Platform in groups, resulting in adverse impacts.

    2. The Advertiser abuses, threatens, or otherwise behaves in an unfriendly manner toward users.

    1. If the Advertiser's business practices are deemed illegal acts or crimes by law enforcement agencies, the account's assets may be frozen pursuant to law enforcement agency requirements.

    1. The Advertiser uses associated accounts for receipt and payment on any other Platform or community. If the Platform's risk control team determines that the Advertiser's accounts on other Platforms or communities are inextricably linked to the Advertiser on this Platform (for example, they are accounts and alternate accounts registered by the Advertiser on other Platforms), or that the Advertiser is connected to money laundering detected on other Platforms, the Platform reserves the right to disqualify the Advertiser directly.

    1. The Advertiser's application materials contain false information.

    1. The Advertiser exploits bugs in the Platform's rules to make a profit.

    1. The Advertiser conducts transactions using cards rented or purchased elsewhere, and is flagged as a possible money launderer by the Platform. If conclusive evidence exists that the Advertiser is directly involved in money laundering, we will directly report it to the appropriate law enforcement agencies.

    1. The Advertiser posts both purchase and sale advertisements with the advertised purchase price greater than the advertised sale price, or causes other price discrepancies that disrupt the Platform order.

     

    Bybit reserves the right to remove advertisements in the following cases:

    1. An advertisement has not been active for more than two (2) days.

    2. An advertisement has potential risks (the potential risk will be judged by the Bybit risk control team).

    3. An advertisement does not meet the conditions and cannot be traded normally.

    4. An advertisement charges extra fees beyond the transaction amount.

    If the Advertiser is being reported for the first time:

     

    The Advertiser's advertisement will be removed, and the P2P transaction function

    will be restricted from trading for 7 days.

     

    After 7 days, the Advertiser needs to contact support to appeal to reactivate P2P transaction function.

    • If successful, the Advertiser's P2P transaction function will return to normal status.

    • If unsuccessful, the Advertiser's P2P transaction function will continue to be restricted.

    If the Advertiser charges additional fees again after the transaction restriction is lifted, the Advertiser will never be able to perform P2P transactions on Bybit.

     

    1. The advertised price is abnormally high.

    2. The Advertiser has an abnormal number of advertisements with different fiats, or abnormal orders that have been noticed by the Bybit risk control team.

    3. The Advertiser commits fraudulent practices.

    The payment by the Advertiser, as the buyer, results in the freezing of the accounts of other users and the Advertiser fails to respond to the user within 24 hours of notification (failure to process within the time limit, restriction on the purchase function of the account)

     Risk control triggered

    It is established that the Advertiser's payment to the user results in law enforcement agencies freezing the user's bank card and other financial accounts.

    Restrictions on ad publishing or disqualification

    After the risk control system detects discrepancies, the Advertiser expressly declines or does not actively participate in additional anti-money laundering review tasks required by the Platform's risk control.

    Disqualification

     

    The Advertiser uses the same bank card account on our Platform when trading on other P2P Platforms, and the money received is used directly for payment on our Platform, resulting in law enforcement agencies freezing users' accounts.

    All advertisements are closed, their publication is restricted, or they are disqualified.

     

    The Advertiser sells coins via alternative accounts or affiliate accounts and transfers funds directly to other Advertisers.

    All ads have been withdrawn, had their publication restricted, or been disqualified

     

    The Platform has reasonable grounds to believe that the Advertiser is directly involved in or aids the management of problematic funds or assets.

    Account suspension, disqualification, affiliate account suspension, and referral to appropriate law enforcement agencies

     

    The Advertiser shall not introduce users to this Platform who are involved in Ponzi schemes, pyramid schemes, or romance scams. The Advertiser shall not transfer funds to the accounts of other Platform users if the Advertiser knows or reasonably infers that the funds received from other Platforms or WeChat groups are considered illegal.

    The Platform has determined that the Advertiser transmits sensitive information, or tests the card by transferring funds to other Advertisers on the Platform using the accounts of other people.

    The Advertiser does not release the token within 30 minutes of receiving notification from customer service that the user has made the payment.

    The Advertiser is engaged in serious verbal conflict or other unethical behavior with Platform users or staff.

    Disqualification

    The Advertiser is screened by the Platform's risk control team and determined to have rushed to place low-price orders, or to have been involved in the settlement process.

    Risk control verifies, or users report, unusual order advertisements (for example, the minimum and maximum amounts are close: 30,193 and 39,013; the minimum amount of a single transaction is set in conjunction with the maximum number of order receipts; risk control determines other abnormal advertisements)

    Disqualification

     

    An advertisement shall be deemed as invalid if an advertisement is placed on the market that is buy high/sell low, and the advertisement conditions and limits are set very high, preventing users from placing orders.

     Customer service intervened in filing the order complaint

    While the advertisement was online, the cell phone number bound to the Platform could not be turned off or shut down, the order did not release coins within the required time, and two user’s orders complaints were collected. Customer service intervened and contacted the Party on multiple occasions for 15 minutes. After customer service’s intervention, the Party still had not accepted the order, completed the payment, and canceled the order within the required time. At least thirty (30) users' order complaints were collected, and the Party failed to answer several times after five (5) minutes of customer service staff’s calls.

    Malicious Claim: 1) Buyer fails to pay but clicks on the File Order Complaint button when the seller's receiving method is standard. 2) The seller does not release the order but clicks on the File Order Complaint button when the buyer has not violated the law

    The Advertiser's payment account was abnormal, and the Advertiser needed to provide a new method to receive payments. After receiving payment, the Advertiser did not release the order within 30 minutes. The user then filed an order complaint.

    The payment account provided by the Advertiser is unusual, and the Advertiser does not provide a valid payment method in time. The user is unable to complete the payment and files a complaint.

    As the seller, the Advertiser cancels or delays the order over time after the buyer's transfer is completed. The seller fails to address the issue, even after customer service intervenes with an agreed method.

    15. Limitation and Exemption of Liability

    The advertising party shall follow the limitations and exclusions of liability agreed to in the Platform's User Service Rules and shall carefully read and comply with the following exclusions or limitations of liability:

     

    You shall pay attention to anti-money laundering risks, due to the complexity of OTC funds and the specialty of digital asset transactions. In order to ensure the safety of your own transactions and assets, you must conduct transactions in strict compliance with these procedures and rules, as well as verify and authorize the counterparty's identity pursuant to KYC and anti-money laundering requirements. You may face the risk of having your assets frozen if the counterparty is suspected of a crime. The Platform does not assume any responsibility for the resulting losses.

     

    The Platform only provides integrated information services for digital asset P2P transactions, and the buying and selling behaviors and transactions on the Platform are all completed independently and spontaneously by users. The Platform is not involved in the transaction process. You shall independently assume any risks and subsequent losses should you violate Platform transaction rules and agreements. We shall not assume any liability for indemnification. The Platform also does not endorse the Advertiser's brand or credit for any violations of the rules. The Platform does not assume any joint liability for any adverse consequences arising from the Advertiser's own actions.

     

    In order to prevent criminal entities from using this Platform to engage in illegal activities, such as money laundering, foreign exchange fee avoidance, and arbitrage in a disguised form, the Advertiser should avoid introducing illegal OTC assets into this Platform (in particular, the Advertiser should perform risk identification control of the counterparty and effective isolation of the asset account when performing trans-Platform coin withdraw P2P transactions with liberty). The Platform has the right to take a number of punitive measures against the advertising party, including but not limited to account restriction, freezing of account, advertising disqualification, and referral to law enforcement agencies if the Platform confirms that the advertising party is suspected of using the Platform to carry out various forms of illegal or immoral behavior (such as intentionally renting or buying out multiple cards for others for money laundering transactions, or trading U.S. dollars in the bulk area, or areas prohibited by the Platform, without authorization). The Platform shall not be liable for any losses incurred by the advertising party or any related third party.

     

    The Platform does not encourage the advertising party to rent, buy or sell multiple cards for other parties to perform transaction activities arbitrarily:

    (1.) The Platform is not responsible for any resulting losses, should the actual owner of the cards suffer any losses due to the Advertiser performing money laundering activities by renting, buying or selling cards for others. The Platform has the right to directly report the Advertiser to law enforcement agencies if the Platform has confirmed that the Advertiser has participated in any of these activities. The Platform shall not bear any responsibility for adverse consequences caused to the Advertiser.

    (2.) You shall actively cooperate with users to unfreeze their card(s) if you have previously used a card borrowed or purchased from another user to make transactions, and their card is subsequently frozen by law enforcement agencies, despite being valid at the time the transaction was made. The Platform has the right to deduct any indemnification paid for user losses from your assets, and shall not assume indemnification liability for any losses you suffer as a result of your failure to fulfill your obligations.

    In order to ensure the verification of KYC identity information, the Platform may contain links to third-party websites (e.g., online banking websites) (hereinafter referred to as "Linked Sites"). The "Linked Sites" are not under the Platform’s control. The Platform does not guarantee or promise any information, products, business, or content that does not belong to the Platform. It is your own decision to use any services, information, and products provided by third-party websites. Therefore, you shall assume all resulting liability. 

     

     

    Miscellaneous

    This Agreement shall take effect from the date of the issuance. It shall be terminated on the date when you have either fulfilled your obligations under this Agreement, or your Advertiser eligibility is revoked.
